DEALFOREST TERMS OF SERVICE


I. GENERAL PROVISIONS
These Terms of Service specify the principles for the provision of services by MydealForest.com, based in Port Harcourt.


The services provided by MydealForest.com and functionalities available may vary from country to country. Information on the services, functionalities, software or other infrastructure made available by the Service Provider in another country may be found on the Site.


The Terms of Service provisions related to a particular Service, functionality, software, or infrastructure do not apply to Users from countries where such offerings are unavailable.
To streamline this document, the term “DealForest” will collectively refer to all products and Services provided by the Service Provider, including but not limited to the Site, Application, Plugin, software, infrastructure, Services, and functionalities.

The Service Provider continuously makes these Terms of Service available on the Site, allowing Users to access, print, or save them to a storage device at any time using their computer system, Additionally, if the Service Provider provides software or infrastructure other than the Site in a specific country, these Terms of Service may also be accessible in those locations.
Unless otherwise stated, all rights to DealForest, including its Services, functionalities, and components, as well as property copyrights, intellectual property rights to its name, domain name, website, software, and infrastructure, forms, logos, and content posted by the Service Provider, are owned by the Service Provider and may only be used in accordance with these Terms of Service and applicable laws.


You are prohibited from copying, reproducing, modifying, or distributing any part of DealForest, its Services, functionalities, or elements without the Service Provider’s prior written consent, except as permitted by applicable law and these Terms of Service. The Service Provider reserves the right to take measures, including legal action, to protect its interests and those of its Users.
The Service Provider may post or make available on DealForest, including the Website, software, infrastructure, Services, or functionalities, advertising content related to its Services, as well as third-party goods and services, in various online formats. The use of such offers or services is separate from DealForest and is subject to the terms and conditions of the relevant third-party providers.
The provision of additional Services, programs, or campaigns organized or made available by the Service Provider may be subject to separate rules and regulations, which may be included in supplementary documents attached to these Terms of Service.


II. DEFINITIONS
The following definitions apply to terms used in this document:
Service Provider – Dealforest Limited, with its registered office in NO.21 Rumuoke Road Ada-George Port Harcourt Rivers State.

Website/Site: the website located at MydealForest.com, owned and operated by the Service Provider, providing Users with access to the Services and functionalities offered by the Service Provider.
Application/Mobile Application: software developed by the Service Provider, available through mobile application stores and similar platforms, designed for installation on mobile devices, enabling Users to access and utilize the Services offered by the Service Provider.

DealForest Plugin/Extension: software created by the Service Provider, available for installation through specified web browsers, allowing Users to enhance their browsing experience with additional features and functionalities.

User: a natural person who uses DealForest for personal, non-commercial purposes, unrelated to their business or professional activities.

Services: electronic services provided to Users by the Service Provider, as defined in the Electronic Transactions Act 2011 on the provision of services by electronic means. If a DealForest Service or functionality is deemed Digital Content or Digital Service under applicable law, the relevant provisions of these Regulations and applicable laws will apply. Otherwise, the standard Service-related provisions of these Terms and Conditions will apply to Digital Content and Digital Services, unless separate provisions or rules specifically for Digital Content and Digital Services are explicitly provided.

Discount Code: a unique sequence of numbers, letters, or characters that enables Users to participate in promotional campaigns, discounts, or other offers organized by third parties, subject to their specified terms and conditions.

Account: a personalized section of the Site, Application, or other software/infrastructure provided by the Service Provider, where a User can perform specific actions within DealForest, as described on the Site.

Agreement: refers to the contract between the User and the Service Provider for the provision of Services, delivery of Digital Content, or Digital Service.

Digital content: data produced and supplied in digital form, as defined in the Consumer Protection (E-commerce) Regulations, 2022.

Durable Medium: as defined by the Consumer Protection (E-commerce) Regulations, 2022.

Digital Service: as defined by the Electronic Transaction Act, 2011.

Electronic Transaction Act: Electronic Transaction Act, Cap E12, Laws of the Federation of Nigeria, 2011.

Consumer Protection (E-commerce) Regulations: Consumer Protection (E-commerce) Regulations, 2022, Federal Republic of Nigeria Official Gazette.

III. GENERAL TERMS OF USE OF DEALFOREST

Using DealForest is subject to the rules outlined in the Terms of Service and must comply with all applicable laws.
To use the Site, you’ll need:
A device connected to the Internet
Access to an email account
The latest version of web browser with JavaScript enabled Cookies enabled
Software to read PDF files
To use the Application, you’ll need:
A mobile device with an operating system compatible with the Application, as specified in the application store.
Installation of the Application on a compatible mobile device.
Internet access on the mobile device.
Access to an email account.
An active and properly configured data transmission service (e.g., cellular network or Wi-Fi).
To use the Application, follow these steps:
Read the Terms of Service and information about the Application available in the app store.
Download the Application from the designated app store.
Install the Application on a compatible mobile device by following the on-screen instructions.
To access certain services or features in the Mobile Application, you may need to:
Enable location services on your mobile device.
Grant the Application permission to access your device’s location services.
To use the Plugin and its features, you’ll need:
A device connected to the Internet.
Access to a compatible web browser, as specified by the Service Provider on the Site.
To use the Plugin, follow these steps:
Download the Plugin.
Install the Plugin.
Follow the Service Provider’s guidelines for installation and setup.
Additional requirements for using other products or services, such as software, infrastructure, or functionalities, may be specified:
On the Site.
Directly within the product or service itself.
Using the Application, Plugin, or other software is subject to these Terms of Service, with an indefinite agreement that can be terminated by uninstalling the software at any time.
The Service Provider grants the User a license to use the Application, Plugin, or software upon downloading, which is non-exclusive, non-transferable, territorially unlimited, and free of charge, granted for an indefinite period limited to use within a specific device, software, or browser, and entitling the User to use it within their devices, software, or browser without sublicense rights, for introduction, saving, display, and temporary reproduction purposes.
The Service Provider may establish separate licensing rules for specific products, Services, Digital Services, or Digital Content, but in the absence of such rules, these Terms and Conditions will apply.
The Service Provider reserves the right to terminate the Agreement if the User breaches the license terms and conditions, following a prior notice to remedy the violation.
Using electronically provided services carries inherent risks, including malware installation and unauthorized data access, which can be mitigated by the User employing suitable technical safeguards, such as anti-virus and firewall software.

IV. USER RIGHTS AND OBLIGATIONS

The User is prohibited from using DealForest, its Services, or functionalities in any way that breaches the law, offends decency, infringes on third-party personal rights, or undermines the Service Provider’s legitimate interests, including uploading unlawful content.
The User must use DealForest in compliance with the law, morality, and these Terms of Service, respecting third-party rights and intellectual property, providing accurate and up-to-date data, refraining from using disruptive devices or software, and not uploading unlawful content.
The User is prohibited from engaging in activities that overload other Users’ or the Service Provider’s inboxes, specifically including the sending of unsolicited advertising messages.
The User has the right to withdraw from the Agreement within 14 days without giving any reason.
Sending the declaration prior to the deadline is sufficient to meet it.
The withdrawal period begins on the date the Agreement is concluded.
The User can withdraw by submitting a personally drafted statement or using the template provided by the Service Provider, which is attached as Appendix 1 to these Terms and Conditions.
Upon receiving the User’s electronic withdrawal declaration, the Service Provider will send a confirmation acknowledging receipt of the withdrawal declaration.
If the User withdraws from the Agreement for Digital Content or Digital Service, they must immediately cease using the Digital Content or Digital Service and refrain from sharing it with others.
In the event of withdrawal from the Agreement for the provision of Digital Content or Digital Service, the Service Provider may not, from the date of receipt of the User’s declaration of withdrawal from the Agreement, use content other than personal data provided or created by the User in the course of using the Digital Content or Digital Service provided by the Service Provider, except content that:
are useful only in connection with the Digital Content or Digital Service that was the subject of the Agreement; relate solely to the User’s activity while using the Digital Content or Digital Service provided by the Service Provider; have been combined by the Service Provider with other data and cannot be separated from them or can only be separated with disproportionate effort;
have been created by the User together with other consumers who can still use them.
At the User’s request, the Service Provider will provide the User with content created or provided by the User while using the Digital Content or Digital Service, excluding personal data.
The User has the right to retrieve their Digital Content from the Service Provider at no cost, without obstruction, within a reasonable timeframe, and in a widely used, machine-readable format.
Upon withdrawal from the Agreement, the Service Provider reserves the right to prevent further use of the Digital Content or Digital Service by the User, such as by restricting access or blocking the User Account, without affecting the User’s rights to retrieve their Digital Content.
The User has, for instance, the following options to use out-of-court complaint and claim procedures:
National Consumer Complaints Commission (NCCC): A Nigerian government agency that handles consumer complaints.
eResolution: A Canadian-based ODR platform that provides mediation and arbiter services.
American Arbitration Association (AAA): Offers online arbitration services.
European Commission’s Online Dispute Resolution (ODR) Platform: For EU-based clients.
International Chamber of Commerce(ICC) Dispute Resolution Services: offers arbitration, mediation and other ADR services.
London Court of International Arbitration (LCIA): Provides arbitration and ADR services.

Details about accessing dispute resolution procedures are typically available on national consumer protection authorities’ websites.

V. SERVICES

Services offered by the Service Provider on the Site may differ from those provided through the Application, Plugin, or other software and infrastructure.
DealForest, additional services may be subject to separate rules and regulations.
DealForest’ standard services include:
Sharing information, content, and promotions with third parties.
Sharing Discount Codes.
Enabling and displaying user opinions.
Providing interactive contact forms
Maintaining user Accounts.
Sending Newsletters.
Displaying notifications, including push notifications.
In selected countries, the Service Provider may offer additional services and functionalities, accessible through various channels such as Applications, Plugins, software, or infrastructure. The Site will provide information on available services, functionalities, and products specific to each market (country).
The scope of specific services and functionalities will be specified within DealForest.
The Service Provider reserves the right to present information and content in DealForest, including details on promotions, discounts, and offers from third-party sellers of products or services.
The Service Provider may provide Users with Discount Codes to reduce prices of products or services offered by third parties, allowing Users to view and copy the codes.
The Service agreement for accessing bargain information and Discount Codes is concluded for a limited period and ends when the User closes the Website, Application, Plugin, or other software.
Users can share personal opinions on DealForest Services or content.

The agreement for posting opinions is temporary and ends when the opinion is removed from DealForest.
By posting an opinion, the User guarantees they own the necessary rights, including copyrights. The User consents to the Service Provider’s free use, publication, and development of the posted content in DealForest and other Service Provider channels.
User-posted opinions must comply with applicable laws and good practices. The Service Provider doesn’t verify the accuracy of user statements and doesn’t confirm if they’re from actual customers. DealForest may also display opinions from external platforms like Google, for which the external platform is responsible, not the Service Provider.
Users can send messages to the Service Provider through a contact form. The service contract, which provides an interactive form for contacting the Service Provider, is temporary and ends with the Service Provider’s response. DealForest forms are not online communication tools unless specified otherwise within DealForest.
The Account Service is accessible after registering with DealForest by filling out and submitting the provided registration form.
Users can create an Account or log in using their Facebook or Google account credentials.
By registering/logging in with Facebook or Google, users publicly share their full name and profile picture in DealForest, and this data may be stored on the Site.
The agreement for maintaining an Account in DealForest is indefinite and ends when the User requests Account deletion or deletes it themselves (if available).
In countries where the Service Provider offers multiple products, Users can only register once in DealForest, resulting in a single Account. However, this single Account can be used to log in to multiple DealForest products, unless otherwise stated.
Account sharing with third parties is prohibited.
The User agrees to the public sharing of their uploaded image within the Account.
The User allows the Service Provider to use and publicly display their uploaded image for the purpose of providing Account functionality and DealForest services.
The Participant provides this consent without charge.
To activate their Account, the Participant may be required to confirm their email address.
The Account holds the Participant’s registration data. If any information changes, the Participant must update it promptly using the Account’s tools or, for non-editable fields, contact the Service Provider.
Users can opt-in to receive commercial emails (Newsletter) from the Service Provider by providing a valid email address or enabling the corresponding option in DealForest. Users can withdraw consent and unsubscribe at any time. The Newsletter agreement is indefinite and ends when the User requests removal or unsubscribes via a link in the Newsletter email.
The Service Provider may display notifications, including push notifications, to DealForest Users. To receive push notifications, Users must opt-in through a prompt in DealForest or by adjusting their device or browser settings.
If any DealForest Services or features qualify as Digital Services or Digital Content, as defined in the Terms and Conditions, all relevant provisions of the Terms and Conditions and applicable laws governing Digital Content and Digital Services will apply.
Unless otherwise stated, these Terms of Use provisions related to Services will also apply to Digital Content and Digital Services, to the extent permitted by applicable law.
When the Service Provider provides access to Digital Content or Digital Services, DealForest will display information on the delivery method and timeframe.
If Digital Content or Digital Services are not delivered, Users can exercise their rights under the Consumer Protection (E-commerce) Regulations, 2022, which may include requesting delivery or, in certain cases, withdrawing from the agreement.
Unless otherwise agreed, the Service Provider will deliver the Digital Content or Digital Service in the version available on the agreement date, as specified by the Service Provider.
The Service Provider may modify Digital Content or Digital Services for legitimate reasons, including:
Changes in laws or interpretations affecting the service.
Court decisions, rulings, or acts impacting the service.
Improvements for organizational, technological, or technical reasons.
Changes in technical requirements or business scope.
Security reasons.
Eliminating malfunctions or preventing abuse.
This is subject to Users’ rights under applicable law.
The changes mentioned earlier do not apply to Digital Content and Digital Services that are provided as a one-time transaction.
The changes made to the Digital Content or Digital Services will be at no additional cost to the User.
The Service Provider will notify the User of any changes made to the Digital Content or Digital Services and inform them of their associated rights.
To use Digital Content or Digital Services properly, Users must install updates provided by the Service Provider (when available) and follow the Service Provider’s instructions.
Users are asked to cooperate with the Service Provider to ensure the agreement is fulfilled, while respecting their rights and obligations under applicable law. Specifically, Users should cooperate reasonably and use minimal technical means to help determine if issues with Digital Content or Digital Services are caused by their digital environment.

VI. COMPLAINTS

Users can submit complaints to the Service Provider regarding Services within DealForest, including issues with performance, non-performance, or non-compliance with the agreement.
The Service Provider is responsible to Users for any non-compliance of the Digital Content or Digital Service with the agreement.
If the Digital Content or Digital Service doesn’t meet the agreement, Users have rights under the Consumer Protection (E-commerce) Regulations, 2022, including the right to demand that the Service Provider bring it into compliance with the agreement.
The Service Provider is responsible for covering the costs of bringing the Digital Content or Digital Service into compliance with the agreement.
Users can submit complaints in any form they choose, and can send them to Contact@Mydealforest.com.
When submitting a complaint, Users are asked to provide the following information:
Name (first and last name or company name)
Address (residence or registered office)
Email address
A clear description of the issue or event causing the complaint
If a complaint is incomplete, the Service Provider will request that the User provide additional necessary information to process the complaint.
The Service Provider will respond to the complaint within 14 days of receiving it.

VII. PERSONAL DATA PROTECTION

The rules and guidelines for protecting Users’ personal data are outlined in the Privacy Policy.

VIII. FINAL PROVISIONS

The Service Provider’s obligations are based on these Terms of Service and applicable laws that are mandatory and cannot be waived.
The Service Provider does not organize, co-organize, or execute promotional, discount, or other campaigns run by third-party companies.
Third-party companies are responsible for the operation, rules, and usage terms of their individual promotional, discount, and other campaigns.
The Service Provider displays information about promotional, discount, and other campaigns on DealForest, which is prepared and provided by the third-party companies that organize and are responsible for these campaigns.
Nigerian law will apply to any disputes arising from these Terms and Conditions, unless mandatory laws require otherwise.
If the laws of the User’s home country or other applicable laws provide more favorable terms and conditions for the User than Nigerian law and these Terms and Conditions, the more favorable provisions will apply.
Any disputes between the Service Provider and the User will be resolved by Nigerian courts, unless mandatory laws require otherwise.
For any issues not addressed in these Terms of Service, the relevant provisions of generally applicable law will apply.
The Service Provider reserves the right to modify these Terms and Conditions in the following situations:
Changes in laws affecting the Terms and Conditions
Obligations imposed by state authorities
Improving DealForest ‘s operation and user experience
Enhancing user privacy protection
Preventing abuse and ensuring security
Changes or expansions in services, digital content, or functionality
Editorial changes
The Service Provider will follow a specified procedure to make these changes.
When changes are made to the Terms and Conditions, the Service Provider will notify each User through the Service, providing:
A summary of the changes
The effective date of the changes
Users will have at least 14 days’ notice before the changes take effect.
If an Account holder doesn’t agree with the updated Terms and Conditions, they must notify the Service Provider within 14 days of being informed of the changes. This notification should be sent to the Service Provider’s email address. Failure to accept the changes will result in termination of the Agreement.
